If a debtor is self-employed, we are required to do quite a
bit more additional work in determining the estimated value of the business,
whether it can be exempt from the reach of creditors, and how many business
creditors need to be included in the filing, etc. Our fee for a Chapter 7
bankruptcy for a self-employed person typically is $1,400, plus $299 filing fee. All fees must be paid in advance of filing for two reasons: first, an attorney is not allowed to be a creditor in the same bankruptcy in which represents the debtor, and second, any portion of the bankruptcy lawyer's fee that is not paid before the date of filing of a Chapter 7 cases may be wiped out in the bankruptcy. Some attorneys keep this little bit of information secret, and allow debtors to make monthly payments, and never tell the debtor(s) that they are not required to make future payments. Moreover, any written agreement offered by an Orange County bankruptcy attorney that waives the debtor's right to wipe out attorney's fees in the bankruptcy is void and unenforceable.
