ABOUT OUR FEES...

Our Chapter 7 Orange County bankruptcy attorneys programs offers various prices depending on how difficult and time-consuming the case may be.  A typical fee is $1200 for full case preparation and representation. The fee includes an in-office client intake interview, 3-way Credit Report (Experian, TransUnion, and Equifax), preparation of the bankruptcy petition, schedules and statements, filing with the court, communicating with the trustee, and representation with the debtor at the Trustee Interview.  This is a flat fee, and no additional charges are typically incurred unless the debtor has withheld information that requires their bankruptcy documents to be amended, or unnecessary additional appearances are required.

If a debtor is self-employed, we are required to do quite a bit more additional work in determining the estimated value of the business, whether it can be exempt from the reach of creditors, and how many business creditors need to be included in the filing, etc.  Our fee for a Chapter 7 bankruptcy for a self-employed person typically is $1,400, plus $299 filing fee.

Chapter 7 Orange County bankruptcy lawyers fees for a corporation are typically $3,000 - $4,000, depending on the size of the business, number of liquidable assets, and the number of creditors with which the attorney must deal.  Many corporation debtors are often surprised to learn that filing a Chapter 7 bankruptcy is often unnecessary for a corporation.  Dale and Sean will be happy to explain this to you.

All fees must be paid in advance of filing for two reasons:  first, an attorney is not allowed to be a creditor in the same bankruptcy in which represents the debtor, and second, any portion of the bankruptcy lawyer's fee that is not paid before the date of filing of a Chapter 7 cases may be wiped out in the bankruptcy.  Some attorneys keep this little bit of information secret, and allow debtors to make monthly payments, and never tell the debtor(s) that they are not required to make future payments.  Moreover, any written agreement offered by an Orange County bankruptcy attorney that waives the debtor's right to wipe out attorney's fees in the bankruptcy is void and unenforceable.

When hiring an bankruptcy attorney in Orange County one should not look for one with the lowest fee, but for one who is highly experienced and whose fees are reasonable.  By "highly experienced", I mean one who has prepared hundreds of successful cases, not just a few.
